    I have today received a Witness Statement from DEAL, pages of it, itemising all their extra costs etc. The last paperwork I received from the court clearly stated that they had to pay their hearing fee by 20/2. The court confirmed they had not paid but for some reason they have been given until 5/3 to pay, I wont know the reason for that until I receive a letter on the way to me from the court.
    Is this claim from them their final scare tactic or in the worst scenario might I have to pay that figure?
    I have registered for mediation with the court mediation service, who tell me that DEAL have not, is that relevant?
    I have never received from them their Directions Questionnaire, I think the rules state that they should have sent me a copy, I certainly sent them a copy of mine, by recorded delivery.
    CEL no longer manage this carpark, I think I read somewhere that the Co-op cancelled the contract early for reasons you may like to imagine, any relevance ?
    All these figures being banded about by DEAL.....I notice there is never any mention of VAT, is it not a legal requirement for a firm to state whether any amounts are inclusive of VAT and to quote their VAT Reg No ?
    Any advise please.

    To costs, yes. It helps you win or lose. Given the gazzillion pounds costs crap you'll only lose if you fold. They're not turning up in case they have to explain that.

      Hi

      I have been in the same situation, CEAL had until 24th Feb to pay and I got confirmation yesterday from the court that they havent, and the judge has closed the case.

      But today I have received the same letter as you and am not sure now where I stand? Can they still carry on after teh judge has closed the matter?

        I cant see how they can continue if the judge has struck out the case. Surely they would have to start from the beginning with a fresh claim/summons which I cant see them doing. Its just a financial balance sheet to them, some pay up and some challenge it, at the end of the day they make a profit.

          They would need to appl for relief from sanctions.

          I'd reply stating that the claim is struck out which then means they can't claim not to know about it and as an application needs to be made quickly also puts them on the clock, so to speak.

            This seems to be happening a lot. CEL/DEAL know that the case has been struck out because they didn't pay the fee but they are having one last attempt to get payment before people get the notification from the court that the case has been closed.

              Is there a chance that DEAL will assign their "debt" to another spurious firm and start the ball rolling all over again?
              There are procedures in place whereby individuals and presumably firms can be made vexatious litigants...
              ............"
              .Vexatious litigants are individuals who persistently take legal action against others in cases without any merit, who are forbidden from starting civil cases in courts without permission". Or have civil restraint orders made against them, see https://www.gov.uk/vexatious-litigants. Is this procedure instigated by a judge ?

                I think so. Trouble with CEL/DEAL is many probably didn't defend so they'll have quite a few wins which are all default judgements.

                  Hello all...sorry to intrude on your thread and apologies if im not allowed to, ive just had the exact same letter for £545 but if i pay £215 now they will settle....mine is interesting as no where in the documents does it have a timing apart from on Exhibit 1 which they have sent in their witness statement reply to mine..ill include my thread and again apologies if i cant...i think it might be quite laughable...the time we were recorded in the car park was for 1 hour and 47 minutes...ive included a picture of thier exhibit 1 in my thread...please tell me the i shouldnt wipe the smirk off my face just yet

                    Hi momorris1980 and others

                    Have you got as far as receiving notification of a hearing date from the court, if you have there will be a date which is the deadline for DEAL to pay their £25 hearing fee. A good idea to ring your local court to see if they have paid, in my case they havent paid so presumably the case will be struck out, am just waiting for a letter from the court. I have read somewhere they are still sending out these £545 invoices to people even though they must be aware that some cases are no longer active.

                      Where in Bradford was yours? ours was in Wibsey!!

                      Mystery1 has started replying to my other thread and i have attached all documents there, i do have a reply from court saying a hearing in April allocated for 1 hour.... (all pics on my thread)

                        Mine was in Duckworth Lane although I live in Wibsey . I called into to the Co-op briefly to get some change, drove to BRI carpark and returned about an hour later to the Co-op carpark and they have me down as being parked for 2 hrs. Have you checked with the court to see if they have paid their fee?

                          I will ring tomorrow to check they have, thank you.... they had us down as staying there 1 hr and 47 minutes (as documented in court papers), but they have sent an exhibit which states 2 hours free parking...its laughable!... what are the thoughts of me counter claiming, or is it too late now and should i let it go if they havent paid?

                            Thanks very much as I have now properly read all the pages they sent me and I am 4 minutes inside the 2 hours !! Quite a revelation although I am not sure about counterclaiming but in my case if it does go to a hearing I will certainly be asking for costs. You know that CEL were sacked by the Co-op so there is now all new signage in Wibsey and Duckworth, a new firm on the job, no cameras but attended by someone.

                              I didnt twig until this morning about the 2 hours thing when they sent their own exhibit lol...as yes its Horizon who do the car park now and thats also 2 hours too..(big sign out front)
                              No there arent cameras because thats the line i was going to go down, im a specialist security engineer, ex armed forces and government cctv installer commissioning engineer. I was going to ask to see images of the time frame, or a database acknowledgement of the reg of the car, i would then of gone down the ICO route (Information Comissioners office) basically its to do with the registering of these cameras within the public domain and how they are used for data gathering, leading onto the the Data protection aspect of it, what they do with our stored data they have bought from the DVLA...its supposed to be stored in special locations, (data centres etc, not personal or company computers etc) i would of then gone down the calibration of the cameras, when last serviced who serviced them, were they NSI / SSAIB accredited or was it a joe bloggs etc, then the analytic software used to gather the information and so on and so on....its a minefield and can catch them out...im not an expert but i know enough where i can find out the required legal information and hopefully something that would of shot them in the foot...i then found this wonderful site while researching.
                              its a guy driving round in a van chancing it basically, drives from one car park to the next writing down registrations in a notebook probably!
