  • Parking Eye charges - What next? Should I appeal to POPLA?

    Hi,
I've just joined the forum. On 1st January 2015 we (my husband as keeper) received a parking charge letter from Parking Eye dated 23rd December 2014 for parking several minutes over the 'free' parking on 11th December 2014. Parking Eye have just rejected our appeal even though we had entered our car reg number and tried to pay at the machine - it displayed a 0 charge and wouldn't accept a payment. Parking Eye say we should have used another machine. It was very dark and rainy and we couldn't properly see, let alone read, any other machine or the signage and instructions.
They have not put a POPLA number on the letter, just say we have 14 days to pay. I feel this is very unfair as we tried to pay. What should I do next?

Ask them where the popla code is.

Once obtained come back for help with a suitable appeal. PLease don't just write to popla and say the machine was faulty or you lose.

22.12 If you reject an appeal you must:
    • tell the motorist how to make an appeal to POPLA.
This includes providing a template ‘notice of
appeal’ form or a link to the appropriate website for
lodging an appeal and a valid 10-digit verification
code. Even if the verification code is automatically
printed on an enclosed appeal form, it must still
be in a prominent position on the first page of the
    rejection letter.
    • give the motorist a reasonable amount of time to pay
the charge before restarting the collection process.
We recommend that you allow at least 35 days from
the date you rejected the challenge.

If you want to, file a complaint with BPA for failure to adhere to the code of practice.
