  • Parking eye

    Hi all

My sister received a notice from this company.

Luckily, our bins had not been emptied since she cleaned out her car and she found her ticket. She was there for 39 mins and paid for one hour , they sent a pic of her entering and leaving the car park.

I noticed that she had only entered the first part of her reg , the rest has not registered for some reason.

She has ignored all threatening letters etc so far, on the advice of her friends, however, I am aware that this advice was relevant previously but not now?

Should she continue to ignore the letters or send them one with a copy of her ticket ? It is quite obvious that she paid for parking. Are they just trying it on?

    Thanks

It would have been easier to have named the driver and essentially started the process off having been within the valid appeal timeframe however given the fee was paid i think it'll be ok anyway.

I'd write to them with a copy of the ticket as if there was still time to appeal. It may not work but if the fee was paid and they go to court having suffered no loss and knowing so then it won't bode well for them. Parking Eye are usually ok at cancelling tickets where the correct fee is paid but usually that is within the 28 day appeal period.

        Dear Sirs,

I, as registered keeper, wish to invoke your appeals procedure. The driver paid the correct parking fee and i attach a copy of the ticket. In any event your charges are penal and not a genuine pre estimate of loss.

Should you reject my appeal please supply a popla code.

        Yours etc

If they reject it and don't issue a popla code go back to ignoring everything but a letter before action or court papers.
