  • Parking Eye - POPLA appeal

    Hi,

    I am new to here so bear with me. I have recently received a parking eye fine in a Home Bargains car park for parking for 14 minutes over the allowed 1 hr 30 minute time. I appealed writing:

    Dear Sirs

    I am writing to you regarding parking charge xxxxxxxxxxx issued to vehicle xxxx xxx on xx/xx/2014, your charge is punitive and unenforceable. I require you to either cancel the charge forthwith or provide me with a popla code so that I can refer the matter to popla.

    Yours faithfully

    I attached my receipt from the store which showed I had spent £84.52 in store, although this receipt shows a time of 11:38 and I was parked until 12:48. I have now received a POPLA code and need help to appeal.

    However my mam also received a letter for parking 30 minutes over the allowed 1 hr 30 mins one week after me and I sent the exact same appeal for her attaching her receipt of £91 and they have cancelled her parking fine.

    Should I mention this in my appeal. I have also written a complaint to Home bargains can they do anything to help me? I am absolutely raging that I have been fined when I was a genuine shopper to Home Bargains.

    Any help appreciated.

    Edit http://www.legalbeagles.info/forums/...-Appeal-Letter to suit. Add in about the payment if you want but as far as popla goes it matters about as much as my shoe size.

      My point here was that my mam stayed 30 minutes over the 1 hr 30 mins time allowed and I stayed only 14 mins over. Her fine has been cancelled and I have a POPLA form to appeal. Should they not use the same reasoning for all parking charges. Both myself and my mam were genuine shoppers to the store spending quite a lot of money. How can they get away with cancelling some charges and not others in very similar circumstances?? Is there any legal route I can go down here??

        Go to popla as i said and you'll win. What happened to anyone else or even you if you had 2 tickets means diddly squat.

          Thanks for your help, I have just sent my appeal so will wait to hear back from POPLA. I will let you know if I win.
