  • Civil Enforement Ltd - County Claim Form Recieved - Advice Needed Please!!

    Hi,

    to cut a long story short over 2yrs ago I parked my car in a Co-op Car Park and stayed there 21mins over the permitted 2hrs. I have so far ignored all letters as suggested by various forums but on sat I received a Claim Form from Northampton County Court basically chasing me for £165. I obviously dont want to pay this so after looking at a previous post with a similar situation I am going to email Co-op inparticular Steve Murrells, Deborah Misell-Williams and the Co-op Customer Careline and see if I can get them to pay it for me. I'll also acknowledge the claim and say I'm going to defend it in order to buy me more time. Is this right? Is there anything else I should do? Any advice would be greatly appreciated!. Thanks

    That's it for now. Need to take further action within 28 of being served the claim form if it's not been cancelled/paid by then.

    Over 2 years ago ? before 1st Oct 2012 ? Are the particulars of claim chasing the driver ? How do they know who that is ?

      Yes it was May 2012. All the papers etc have been sent addressed to my partner as he is the registered keeper but it was me who was driving but they dont know that as we've never entered into any correspondance with them. Will it make a difference whether it was pre Oct 2012? Thanks for the quick response btw!

        Huge difference. Keeper liability, http://www.parkingcowboys.co.uk/keeper-liability/ , was only implemented after your parking so only the driver could enter a contract or be held liable (assuming that a contract could be said to have been entered in to and ignoring that it's a penalty too). So never let them know who was driving or make a post on the internet saying who the driver actually was as that helps them. i.e. "the driver did this" "the driver did that" " someone else was driving etc

        Also did you get a letter assigning 87.5% of the debt to Debt enforcement & action ltd ?

          Oh dear! I dont remember him receiving any letters from Debt Enforcement and Action and he doesnt recall getting any but I cant be 100% sure. So what do you recommend we do? Just pay it and write it off as a bad mistake?

            Certainly not. Continue as you said and if the co-op don't pay/cancel then come back for more help in about 20/21 days
