    Hi all,

    I recently asked for a Writ of Facie to be set aside and I am in court tomorrow for the hearing : need some advice.

    My partner was a volunteer with a community music project. They took on an old night club. It was bordering on derelict. They asked the landlords agents if they could use the loading bay outside whilst they worked on the property as they were in and out all the time with tools and materials and this was agreed, albeit verbally not in writing. The premises was on the first floor of a carpark. the front was the premises frontage and also the Cooperative loading bay and none of their lorries got tickets when they rested up there.

    So nearly 3 years on and they are saying I owe them £800 as each time they ticketed it was parked in an unauthorised area yet no where does it say that it is. I have completed an N244 to have it set aside.

    I also am not the driver of the car, dont drive it and dont have insurance to drive it but I do own it.

    I have tried to argue with Premier parking and their solicitors and they ignore me.

    I have no money but I do have a Community interest company of which i am a director. They say in their letter this writ of facie means they have control of me and my stuff and that they will make me bankrupt if I dont pay up. I cant so I lose everything Ive been working for for a very long time ?

    have they given you proof of the illigal parking, picturs or vids. ? also, i dont know what the term writ of facie meens ?. In all honesty though, if they were parked on a loading bay, theres not many ways to argue if they have proof. does the shopfront have parking of its own ?

    do you meen Prima facie.... is the hearing for you to present evidence that you was not parking there........ have they presented any evidence ?
    crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even
