  • Civil Enforcement Ltd CCJ County Court

    Hi all, would like some advice please it would be really appreciated, i got a County Court Judgement against me at my old address from Civil Enforcement Ltd i only noticed it from my credit file. I contacted Northampton County Court and had to apply to set aside the Judgement at a cost of £80 and the hearing is on January 2014, i had left my old address over 2 years ago and the CCJ was put on September 2013 this CCJ is causing my credit score a problem and want it off ASAP. I received a letter last week from Civil Enforcement Ltd at my new address saying...

    " We are in receipt of your Application for an Order to have the Judgment set aside and our position has not changed. "

    " In accordance with the Court Protocol we suggest , without Prejudice, in resolving the matter without incurring additional costs, Calls can be made to the number below. "

    Anyone had the same problem with this Company, should i ring this company and get it resolved and get the CCJ off my credit file or ignore and see them in court ?

    You will need to put some more info on here for those who can advise are able to help you with your case to get the CCJ set aside you need a good case anything you post will help.

      Thanks wales01man, the CCJ has been put on against my old address i never knew anything about a parking fine until i seen it on my credit file, which i why i have asked the court to set aside the judgement. I have been on voters role at new address previous to CCJ going on old one, they have never sent anything relating to parking fine to new address.

        Naughty, naughty, CEL. Telling the court you lived at one address when you lived at a completely different address in order to gain a CCJ by default may well amount to misleading the court or worse.

        Did you inform DVLA of your change of address when you moved or within 28 days or moving, as required by law?

          Thanks bluebottle i have had 2 addresses since leaving address CEL put CCJ against, and yes i think i would have changed i have proof from DVLA at both address's some where, i left over 2 years ago the CCJ date 6/9/2013 was put against me, i am on voters roll at new address from June/July 2013 they haven't tried hard to find me.

                A couple of questions -

                1. When did the alleged "contravention" take place?
                2. Was this after you sold the vehicle alleged to be involved in the "contravention" and, if so, how long after?

                Unless CEL have already done so, it would be a good idea to ask them to explain their actions. It appears they may well have mislead a court in order to obtain a default judgement. Misleading a court for whatever reason is not something that is taken lightly and, indeed, is taken very seriously.

                  Make sure you do not tell them who was driving. That is pre PoFA and keeper liability. If you were not the driver they are in an even worse position.

                    1. I don't know as i have never received any parking fine as i moved out the address, the first i seen it was on my credit file a ccj. I have no idea when the "contravention" took place i moved out address where ccj was put on over 2 years ago and the ccj was just put on September 2013 this year. I have found a letter from DVLA with new address on dated Feb 2012 where i had moved to.

                      thanks for reply Mystery 1

                      My partner drove my car it could have been her, as i don't have a clue to the "contravention" date/ place etc i am going to county court in January to get this judgment set aside as i am not happy about ccj against my name, i had a great credit rating untill ccj has gone on. They sent me a letter wanting me to ring them as stated in OP and i don't know what to do?

                        Bearing fully in mind Mystery's advice, write to CEL asking them for a detailed explanation, including dates, as to what the hell they think they are playing at. If they are evasive, come back onto this thread for further assistance.

                            ****UPDATE****

                            I went to court today against Civil Enforcement Ltd and they didn't turn up, the judge listened to my case and set aside the CCJ.

                            He said I need to resolve the matter with CEL or they can put the CCJ back on again, can anyone shed light to what he means? I have written to CEL in December regarding the ticket fine/ccj and they haven't responded to my letter.
