Premier Park question.

Hi. Just registered. We received a £120 parking charge notice through the post this morning from Premier Park in Exeter for 11min overstay for weekly shop on family holiday. I have looked through the forum and got a good idea of how these people operate. Rather than ignore the notice entirely, I was thinking of sending an email by way of appeal. Should I send one or ignore it altogether? Thanks.



Hi. I have just received an invoice from you for parking contract violation. In Morrison car park Wootton Bassett 11 min overstay on 30min parking on 26 August. This is an appeal on the basis of excessive invoice total. Damage caused to you through supposed contract violation not £120. Please break down the invoice for me outlining damage to yourselves of 11min overstay on the assumed basis of small claims court contract law violation. Short overstay for genuine weekly shop in near empty car park in area where free parking plentiful. Thanks.

When you appeal do not disclose, either directly or indirectly, who was actually driving. "the driver"

You should simultaneously contact Morrisons armed with your proof of purchase as they might get it cancelled for you.

Don't the two red bits contradict each other. They state they've accepted it as an appeal, then say they assume 'the driver' doesn't want to appeal Appeal what? They've just said they've accepted your appeal.

I'd just write back and ask them for the POPLA code so you can appeal to them. I'm sure (I hope) M1 will correct me if I'm wrong.

Dear appeals team,

Thank you for your correspondence on xxxxxx the contents of which are duly noted.

I refer you to the BPA code of practice to which your company advertises that it subscribes to and would point out that on page 14 there is section 22 which deals with complaints, challenges and appeals.

22.1 Under the Code you must have procedures for dealing
fairly, efficiently and promptly with complaints, challenges
or appeals. The procedures must give drivers and keepers
the chance to challenge a parking charge notice.


As you can see keepers must be given the chance to challenge a ticket. I have done so, as the registered keeper. There is no statutory duty imposed upon myself to name the driver. If you do not accept my challenge please provide a popla code. Failure to issue a popla code is against your code of practice and i will take any such failure to indicate that you accept my challenge.

Failure to adhere to a code of practice to which you subscribe is a breach of CPUTR 2008.

I will now be reporting the matter to BPA, DVLA and Trading Standards. (please do)

Hi. Got a reply to the above letter today, again ignoring everything - see below. (I have made a complaint to BPA about 22.1). Would it be simpler with driver details, in that I could get a popla and it they pay £27?

We note your comment s and must refer you to the protection of freedoms act 2012 - Schedule 4 - Recovery of unpaid Parking Charges

We must now request that you provide the Driver of the Vehicle's details at the time of the alleged contravention. Please note that this should include the driver's full name and serviceable UK address. This information should be provided by 31st October 2013.

If we do not receive this information by the date given, this case will be passed to our Collection Agency and this may result in proceeding with Court Action against the registered keeper of the vehicle.

That thread from the Prankster is absolutely brilliant. I loved the sarcasm with the yellow and green highlights at the end - superb stuff.

As you say, it has a very serious side to it as well, and we have to keep up with the endless twists and turns the PPC's take in their efforts to unlawfully extract money from us.
