Ive just received a parking charge notice from Parking Eye for the sum of £100 or £60 if I pay within 14 days. I was wondering what to do with it as my husband is away for 4 months and I am on my own with 2 kids

The average person would rather the threats go away. Parking Eye have adopted a forceful stance which 95%+ of those who post for help wish to avoid i.e. court. The fact they should win is not too much comfort for them. In light of the fact that parking eye are proceeding to court in large quantities and usually it's the registered keeper they are chasing, it is better to keep the notices and letters so that this information can be used to strengthen a popla appeal and get rid of the matter for the least amount of stress.

Absolutely correct M1. Fortunately Parking Eye are losing 95%+++++ of the ones that are defended in court as well. As you say though, all documentation should be kept.

Another site is also suggesting writing to the Manager of the store where most money was spent (or any money was spent) stating they have received a Parking Invoice and asking if they have consented to these being issued, and if so would they intervene to make it go away. They suggest this before any appeal starts. I'd have to check timescales unless anyone knows them off the top of their head? It would be interesting to hear others' opinions on this.

Another failed Parking Eye court case reported on Pepipoo today, decision made and sent by letter dated 17th July. Once again Parking Eye could not produce evidence of a genuine pre-estimate of loss.

Do you know if the motorist they harassed was awarded costs in their favour? They certainly deserved to receive some form of redress for PE's disgraceful abuse of the courts. I'm going to nip over to Pepipoo for a nosey. :bolt:

Ian2547 is the one I was mentioning. His first letter is comical; his appeal letter is excellent.

To be honest, as long as this is the best Parking Eye produce, they will win nothing.

The ticket I received from Parking Eye had no reference to VAT shown on it. If it was an invoice for payment of a service contract, it must show VAT details on it, ie, for parking services amount owed £50 + VAT at 20% = £60. Since there is no mention of VAT it must therefore be presumed to be nil or zero rated which would be the applicable rate for a fine or penalty, which of course is non compliant to the BPA Code of Practice itself which states that the use of fine or penalty may not be used. That doesn't legitimise the use of a more convenient term though. If the amount demanded were a contractual charge then it fails the test for that based entirely upon the wording on the ticket. It MUST show the VAT details of the company in accordance with the BPA Code of Practice, and it does not, therefore cannot be a breach of an alleged contractual arrangement.

Does this mean that Parking Eye should be reported to HMRC for tax evasion?

Oh, I wouldn't have thought an anonymous phone call to HMRC Fraud Line would be ignored. In fact, the peeps at HMRC VAT Section are quite helpful. You would be surprised - or not - who are always on HMRC's radar for VAT irregularities.
