    More than likely you have a defence, but to be sure could you please post up a photo of the charge notice.
    First remove your name& address and any reference number and the registration number, but leave in all dates and times

    Do not identify the driver and edit your first post so driver is not identifiable e.g. state the "driver did this" the driver did not see..", etc

            Hi ,

            See attached, It appears from what the driver have heard is that they changed the system and only accept online payments . Driver was not aware of
            the change and did not see any signage and definitely could not see anything on exit it was pitch dark no lights as can be seen on images, online they state that payment must be made by midnight the next day.
            the driver states that if there was signage at exit explaining the new payment method , the driver would have paid.

                  You could try sending a letter along the following lines.
                  It is a sound defence, but they may not accept it (upholding appeals doesn't produce an income for them!) and you might eventually have to appeal to PoPLA

                  Dear Sirs

                  I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

                  I note the land on which the alleged event occurred is not relevant land for the purposes of the Protection of freedoms Act 2012. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

                  There is no legal requirement to name the driver at the time and I will not be doing so.

                  Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

                  Yours etc

                    Hi does replying as such stop one appealing to PoPLA ?
                    Does one has to appeal online at : https://payments.apcoa.co.uk ?

                      You can't appeal to PoPLA until you have a code issued by the parking company when they reject your appeal.

                      If you want to raise a challenge by post the address is APCOA PO Box 5767 IV15 0AX.
                      Send by first class post with a free certificate of post from post office

                        Hi all, thanks for the past help, thought I'd let you all know outcome, last month had a letter from parking company..... No further action to be taken.
