  • BCDL PCN Court Claim

    In July 2021 the driver received 2 PCN 's, they were both within 3 days of each other.

    They were at a franchised restaurant at a golf course where a relative of the driver worked, but shortly after getting the PCN's the relative left there and I basically ignored the odd letter that came through as the driver never expected it to go to court.

    However now it's been picked up by DCBL and it has gone to court. The driver received the documentation today.

    What would my next steps be? Thanks in advance.

    If you want help the next step is to post up copies of the PCNs and the court claim.

    You need to acknowledge receipt of the claim, but do not enter a defence

    Send a Subject Access Request to parking company and a cpr31.14 request to DCBL
    There are templates in SHORTCUTS panel on right of this page

    Do not identify the driver when communicating with them or on here (suggest you amend post1 first sentence)

          Could you please repost that PCN.
          This time showing the whole of the document, leaving in all dates and times, but removing identifying details such as name & address and reg.and ref numbers

          I've had a look on Google Earth and see the sign at the Car Park entrance states "for patrons". However can't read the rest of it... could you possibly get a photo of the signs which are (even the small print) completely legible?
          I assume you are/were not a patron.

          Have you asked the club to have the charges cancelled ? That is the easiest option!

              When you go to the club, could you get a picture of the other signs please?

              When trying to get the club to have the charge cancelled, you might be told "it's too late now as it has gone to court"
              That is not actually true as the claim can be discontinued if the land occupier so instructs those managing the car park.

                Called in to the club today. Spoke to the new manager, explained the situation and they said they could get them cancelled so they took away the numbers of the PCNs and I gave them my email too. Hopefully they send me a confirmation email that they’ve cancelled them. However in the meantime should I proceed in case that’s not done in time?

                Also took a pic of one of the other signs I could see on the car park.

                  That sounds positive but, yes, you must follow court instructions, otherwise you run the risk of a default CCJ.

                  So do as suggested in post 2.

                  If you receive a response to your letters post up on this thread.
                  If you don't receive a response give us a nudge around end August/beginning Sept so we can advise on your defence which will be due in 7th Sept.

                    Received email confirmation from the manager that they have requested the 2 tickets to be cancelled by the parking company, however they said that could take 2 weeks to be processed.

                      That's positive, but don't forget that if you hear nothing from the claimant you will need to file a defence.

                        Just out of interest who should the £1 have gone to? the claimant with the sar?

                          The £1 fee doesn't apply in your case as that is the fee for a copy of a Consumer Credit Agreement.
                          You don't have a CCA with a parking company (unless they lent you money which would be a first )
