  • Trace Debt Recovery letter for a Parking Ticket Issued in 2021

Hi, I recently received a letter from Trace Debt Recovery for a parking ticket issued in September 2021. After reading a few LegalBeagles threads, I submitted an access request.

I’ve received a response and was hoping to get some guidance on how to proceed.

The ticket was issued while the cladding was being replaced on my building. Around half the parking spaces were unusable. I appealed the ticket as we’d been told to park where we could for the several months that cladding work was carried out. My appeal was rejected by email and I didn’t receive any further communication until the debt collectors letter.

Is there anything I can do or do I need to pay? Thanks in advance for your help.

Could you please post up a redacted copy of the charge notice (leave in all dates and times).

    Who owns the car park?
Who gave instructions that you could park wherever?

The car park is owned by the housing association. They sent a letter out saying it wouldn’t be possible to park within bays due to the scaffolding but we could park outside the bays. Unfortunately due to the time that’s passed, I can’t find this letter.

The subject access request doesn’t appear to contain the charge notice. It just says:

      Note ID: #####
Parked outside of a single marked bay.
      Date: 30/09/2021 08:05:12

I’ve emailed to request the charge notice.

I have noticed from my appeal letter that it says I was the driver. I’m pretty sure that when I appealed the ticket, it was impossible to submit the appeal without checking a box to say I was the driver.
