  • CP Plus Ltd T/A Group Nexus

    Hello All,

    I would welcome some advice and hope i am posting on the right forum.

    The driver was at Retail Park for over 2 hours and have received a Charge Notice through the post for £60 from CP Plus.
    Should driver pay this charge or appeal?

    Couldn't possibly comment without seeing the Notice to Keeper.
    Suggest you post up a redacted copy, but leave in all dates and times

      Thank you for the swift response
      Redacted copy uploaded. Date of issue is 30/07/24 but driver didn't receive it until 6/08/24

        The only chink I can see is that the PCN does not actually "invite" the registered keeper to pay the outstanding charge.
        The delay in the postal service doe not affect the validity of service of the NTK

        Quite frankly, altho' it goes against the grain, I would pay the reduced amount and avoid months of stress and probable loss at court.

        There is an outside chance the signage is incapable of forming a contract, but a search on Google Earth doesn't produce a legible copy

          Hi Des8, thank you for your advice. It will be possible to get a picture of the signage over the weekend that i can post up? Just to cover all bases before paying the reduced amount?

                As suspected the sign includes a statement about additional charges.

                If you allow the matter to go to court (i.e. you don't pay and they sue you as the driver) there is an argument to be had that the imposition of such charges is an abuse of process and the whole claim should be struck out.
                Sometimes this is successful, but County Court is a bit of a lottery

                If they sue you as keeper they can only claim the £100 plus certain limited costs, so if you lose your total loss will be around £200
