  • MET parking/ Macds disabled bay

    Good evening I have stumbled upon this forum after searching to see if I’m at all able to appeal a parking fine I have received.

    I had parked waiting for my order in a disabled bay with my disabled mother but she was in the back of my car and it never crossed my mind to display the badge as we were just waiting.

    do I have any sort of leg to stand on or am I best just paying the fine?

        If the bay states badge must be displayed you may have an appeal need you to post photos of sign regarding parking in the bay others can then advise

          Also please post a copy of the parking Charge Notice (remove identifying details but leave in all dates and times)

            Hi des8 and wales01man i have attached pictures of the bay. The notice and the PCN. I notice on the notice board it does state leave the badge showing. I have never done this when waiting.

              Have you asked McDonald's if they can get the charge (it is not a fine!) cancelled.
              You'll have to speak to the manager.

              If they won't help you can put up an initial appeal thus:

              Dear Sirs,
              I have received your Notice to Keeper xxxxx for vehicle VRM xxxx

              You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to specify the period of parking to which this notice applies as prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

              There is no legal requirement to name the driver at the time and I will not be doing so.

              I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

              Do not identify the driver to them, or to McDonald's nor on here
