PCN Received - Parking Eye

Hi all. The driver received a PCN after parking their car in the corner shops right across the road from where they live due to roadworks and restricted access on their road (they have a letter from the council with the details). There are signs in the car park that show it is a 2 hour maximum stay but they didn't notice/realise - an honest mistake. They have been over to speak to all of the businesses at the corner shops to ask who employs Parking Eye but none of them seem to know/want to engage and just advised to speak to Parking Eye directly.

The date of the event is over 6 weeks ago but the PCN has only just been received. The PCN states that they wrote to the address that the car was previously registered at, however, the car has in fact been registered at the same address for the last 5 years. The PCN does state 'protection of freedoms act' on it. Can anyone provide any advice? Thanks in advance.

If the PCN is that late the following letter should suffice:



I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

The vehicle has been registered at this address for the past 5 years, so why would you write to any previous address, and from where did you obtain that incorrect information?

Any further communication with me on this matter, apart from responding to my query, together with confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

After double checking the V5C - it turns out the vehicle was still registered at an old address. Must have only changed address on driving licence and for insurance (though it begs the question how they obtained the correct address).

Suppose the driver has no leg to stand on? Can't see them backing down by sending them the letter from the council via appeal as they will surely say there is clear signage etc.
