Issue date on letter 17 days after the alleged incident .

  • Issue date on letter 17 days after the alleged incident .

    Received a Parking notice through the post from g24 and need a bit of advice please as the issue date on the letter is 17 days after incident .


    The alleged incident happened on the 18th of March (photos date stamped on the letter )

    - The issue date on the letter is 4th of April and it arrived on the 12th of April ..

    If I use would the template below found on this forum would this be sufficient in getting the issue sorted ? (Should I restraint from getting into details) , thanks

    "Dear Sirs,

    I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    There is no legal requirement to name the driver at the time and I will not be doing so.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

    On the face of it, that letter seems OK, but only if the vehicle is registered in your name.

    But do be warned that depending on the company involved they are unlikely to accept it, because that won't give them an income!

      Thanks for taking the time out to respond , yes the vehicle is in my name . On the letter there is no mention of protection of freedom on the letter , would this be an issue ? The notice was sent through the post for leaving the vehicle on site at a retail park , is it worth asking for evidence or just try the template not to confuse the matter.

        It really won't matter what you do or say!
        All they want is your money, but as long as they cannot identify the driver they will have difficulty collecting.
        The driver is possibly liable for the charge, but if they do not know the identity of the driver they can if they act in accordance with PoFA 2012 transfer liability from the driver to the keeper.
        One of the conditions is delivering a NTK within 14 days of the event.
        If they fail to comply, whether or not they mention PoFA 2012 is immaterial.

        Some companies cease collection on receipt of the letter, others are more persistent and try and frighten victims into paying

          Thanks again , will get the letter posted off asap ( would recorded be the best option?) .Just a quick question on the back of the NTK it states that all correspondence must include your name , address and vehicle registration , is this correct ? They surely have it from the notice number .

            Send first class with free certificate of posting from post office ..... no need for recorded

            Obviously they have your name, address & reg number (they've been writing to you!) so no reason not to include your address etc on a letter .... in fact it would be odd not to.

              Just seen that I can do the appeal online from the drop down menu , should I select Registered Keeper ?

                I haven't seen their appeals online facility and personally wouldn't bother using it.
                However if you chose to do so just do not identify the driver, so you probably need to select "Registered Keeper"
