  • PCN Received, Appeal ignored.

    Hi,

    On the 06/09/23 the registered keeper received a PCN from Smart Parking Ltd with the following dates included:

    Date of contravention: 04/08/23

    Date Issued. 25/08/23

    On 20/09/23 a template response from this website referring to Schedule 4 of The Protection Of Freedoms Act 2012 and their failure to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act was used in their online appeals procedure.

    An email acknowledgement was received 2 days after the appeal submission on the 22/09/23 stating that they would respond within 35 days.

    No response to the appeal was ever received.

    Today (24/11/23) the registered keeper has received a letter from Debt Recovery Plus dated 16/11/23 stating payment to be made by 30/11/23.

    I would be grateful if any experienced site members could advise on how to proceed in this situation please?

      Debt Recovery Plus are debt collectors and may be ignored.

      However I would write to Smart Parking and remind them you had appealed on dd/mm as their NTK was out of time,
      Advise them you have not been told the result of your appeal and so they should instruct their debt collectors to cease writing to you.
      Point out that under section 40 of the Administration of Justice Act 1970 and section 2 of the protection from Harassment Act 1997, they must stop sending you letters until there is a decision on your appeal.
