  • Is the bailff in the wrong??

    So yesterday i had a Bristow and Sutor bailiff turn up for unpaid car parking ticket
    i did contest ticket but local incompetant council say they havent rec'd anything.
    i also had no further communication until the visit.

    He threatened to take my car worth 8K for a £394 balance - a car I use for work (community nurse)
    refused a payment plan
    Did not enter home
    Told me if i didnt pay my car would be gone in 2hrs.
    NO help from council whatsoever when i called.

    Im a single mum of 2 got moved to current address due to domestic violence so have limited income...
    I have been told to appeal through TCES but he gave me wrong number to phone and start process....went online and will have to pay another 108 quid if i take it to appeal ??????

    Welcome to LB

    I can help with the complaint part, which you should, simply because you are a Community Nurse, if he took your car, how does he expect you to get around? patients rely on you on a daily basis. It defeats logic.

    Also lodge a complaint with your Council, it can be done online, if it isn't resolved complain to the LGO, once you get a final response / deadlock letter.

      Thankyou so so much for this advice...
      I just feel like he gave me no options at all.
      My car is even on HP and still he wouldnt budge.

          Which council issued the original PCN/Penalty Charge Notice ('parking ticket')? Appeals to parking adjudicators are different depending whether you are in London or elsewhere in England and Wales (Scotland is different again).

          Who is TCES? Neither of the adjudicators are called TCES and both are free to use.

            It was Gloucester City council....
            They are so incompetant its unreal blame it all on a cyber attack *♀️
            TECS (sorry) is who the bailiff told me to call they are the Traffic Enforcement that will apply to district judge for appeal of fine

              I have just sent email of complaint to Bristow and Sutor outlining what was not offered to me and the manner in which I was pressurised to pay. So fingers crossed!!

                Complaining about the conduct of B&S when they came to your house won't get the PCN cancelled though. Have you given up on trying to get the PCN cancelled?

                It sounds like you may not have received all the paprwork that you should have done. Is your vehicle registered with the DVLA at your current address? ie, Does your DVLA vehicle log book ('V5C Registration Certificate') show your current address? You mentioned that you had to move.

                  If you've reached the stage of bailiffs knocking on the door that means that several legal notices have not reached you. If you are the Registered Keeper (RK) with the DVLA and your address on your V5C is correct this really should not have happened.

                  So do you possess your car's V5C and is your name and address on it correct?

                  But if you've got the car on HP it's more than likely that somebody else (the finance company?) is the RK. Do they know what your current address is?

                  There has to be an explanation for so much paperwork to go astray.

                  With bailifs knocking on the door this is a somewhat urgent matter that you need to resolve quickly.

                  I'd suggest you try posting on the site that specialises in council parking tickets. Search this term: pepipoo and post on their council tickets board. Don't try to register with a hotmail address. They might also suggest you visit another site bailiffadviceonline.

                  There's no point complaining about the bailiffs. They're just doing their job and so far as they know you are just another person who doesn't pay their council parking tickets. Being a community nurse is irrelevant. (I say that as a retired NHS employee).

                  Having said that, if you can prove the car doesn't belong to you and it's on HP, then they shouldn't touch it.

                    This is the second time this has happened to me. I've put links in a post that will definitely assist the OP in this situation but the site won't let me post them. The last time this happened I was told that my post had been blocked by the spam filter and somebody on the site team had to intervene to get it posted. Unfortunately in that case the info only got to the OP when it was too late to help them.

                    Can somebody on the site team ensure my post gets through?
