Hi, friend received a pcn from company called Smart Parking through the post. Basic notice sent to keeper. Date of offence 10/3/23. Date pcn issued 31/3/23. Date received through post 21/4/23.
Am I right in thinking they have failed to comply with POFA 2012, in not being sent within 14 days so no liability on keeper to disclose driver details?
Have a funny feeling they will try non POFA route saying they have up to 7 months to do this.
Again am I right in thinking they have failed again to post to keeper within 14 days after obtaining details of keeper from DVLA( BPA code of practice for ANPR) as pcn date of issue 31/3/23?
Further as pcn arrived more than 14 days after it was issued its not possible to even pay the discounted payment offer so is process now null and void?( as again breach of BPA code of practice?
So as long as reply within 28 days should the pcn be dismissed or will they try something else ?
