  • UK Parking Control Ltd - CCJ

    Good afternoon,

    After a visit to our local McDonald’s and stayed probably 25 minutes maximum.

    A few days later we got a PCN through the post from UKPC which I totally ignored and I have ignored all correspondence from them since that. However, today I’ve received the CCJ claim form through the post and obviously I need to act on it.

    In the “particulars of claim” section of the form some things mentioned just don’t add up/untrue. It says the “PCN details are 23/12/2021”, not sure what date this relates to as the alleged incident happened weeks and weeks ago. It also states “The driver agreed to pay within 28 days but did not”, again totally untrue as I have NOT communicated in any way with UKPN Ltd. The total of the claim they now want is astonishing £268.44p.

    All help with what steps to take next will be greatly appreciated. The last thing I want is a CCJ.

    Firstly edit your post so driver's identity is not revealed.

    Secondly, if you still have the original PCN please post up a redacted copy but leave in dates.

    Thirdly acknowledge claim that you intend to defend in full, but don't yet enter a defence

      Hi, thank you for the prompt response. I’ll edit my post now, thank you for that. I don’t have the original PCN either that went in the recycle bin.

        So you need to send a request to the claimant for copies of documents they rely on.
        A template can be found here: CPR 31.14 Request, but you will need to modify it for your particular circumstances as it is really designed for debt claims

        Send it first class with free certificate of posting from post office

              Hi,

              I received the exact same letter from the county court myself today for the same situation but it was not myself driving it was an ex partner. They went through McDonald’s drive thru in my car (they were insured at the time) and parked in the customer car park for 20 mins to eat the McDonald’s and left.

              Can I dispute the claim as it was not myself driving? Also is it classed as an ‘unfair’ parking fine if the car park appears to be for customers of the venue? I don’t believe the average person would look out for parking terms and conditions when parked in a McDonald’s car park with their purchase.

                          In your CPR request you tell the them you want a response within 7 days so that you can inspect the documents before you file & serve your defence on dd/mm ( i.e the day before you actually have to file your defence)

                            Hi Des,

                            Ive not had any response back from UK Parking Control at all. The court extended my time to get my defence in to 31st January, but what should I do next?

                              So you have a couple of days in which to write your defence
                              if you want you can post a draft up here so someone can look it over, but we will also need the full wording of the claim
