Excel PCN - 4 months after event! Please help

Hi All

Excel Parking are outrageous

PCN has been issued but over 4 months after the alleged offence. I am registered keeper but wasn’t driving
the signs state 10 mins to enter and leave the car park….the car was present in the car park for 11 minutes

Question - how best to appeal the charge, it is a PAY car park but not a pay and display. No parking ticket was put on the vehicle at the time and it has taken months for them to issue the fine. How best can I appeal given I thought it was 14 days to send a notice to keeper?

I already had unsuccessful claim from end of August as they blinded me with science and there was no way to appeal a second time, so ended up stumping up the cash

on the basis of what you report, and assuming you have received a "Notice to Keeper" you could respond along the following lines:

I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

There is no legal requirement to name the driver at the time and I will not be doing so.

Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.
