  • Parking Notice Outside 14 days?

    Hello everyone I'm new to this and hoping for some advice regarding appealing parking fine from Britannia.
    Apologies in advance if I've posted this in the wrong place.
    We recieved it on 21/12/22, and Ive read that these should be recieved within 14 days? It states it was issued on the 13/12 and the offence on the 30/11. Unfortunately there is no date on the envelope so not sure how date of postage can be proven.
    The driver actually used the waitrose then went to a hair appointment nearby, hence why the allowed time was exceeded.

    Delete from your post detail which might allow the company to infer the identity of the driver. (some companies do scan these sites!)

    So their notice is dated 13 days after the event, and the law presumes delivery is 2 days after posting, so they have not complied with the 14 day time limit which allows them to transfer liability to the registered keeper.
    Their notice doesn't actually try and transfer liability anyway

    Write to them' first class post with free certificate of posting from a post office

    I have just received your Parking Charge Notice for vehicle VRM xxx

    I am the registered keeper of that vehicle. and note there is no legal requirement for me to name the driver at the time and I will not be doing so.

    Please also note that as you have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver a notice to keeper within the relevant period of 14 days as prescribed by section 9 (4) of the Act. you cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

      Thanks very much for the reply I do just that.
      I cant seem to edit the post, Im using a laptop and managed to edit it before but it seems the edit option has now disappeared.
