  • Non payment from Excel Parking after the court ordered them to pay my costs

    Hi guys

    So back on 9th November i was in court against excel parking services.

    I won the case and excel parking was ordered to pay my expenses of £53 within 14 days.

    Following thr hearing I had a conversation with the solicitor and he asked how id like to get paid. I arranged to be paid via a bank transfer and gave him my bank details.

    So far ive heard nothing from Excel and not been paid by them. Obviously if i was expected to pay the charge im sure they would be issuing a CCJ by now so am wondering what my options are for hitting them where it hurts if possible

    So you can use any of the enforcement options set out in CPR rules 69 onwards. https://www.justice.gov.uk/courts/pr...l/rules#part71

      Hi Guys,

      To add another twist to the issue I was planning on spending Friday afternoon going through my options and following up but today I received a cheque in the post dated 17th November.

      On the day of the hearing the solicitor took my bank details as I said I preferred a transfer. With all the royal mail strikes It's no surprise its late but during the court process Excel Parking Services sacked their legal representation ELMS LEGAL and dealt with the case themselves.

      Now the cheque I have received today is from ELMS LEGAL. According to the document I have they are no longer acting on behalf of Excel Parking Services and the Judge ordered Excel Parking Services to pay the £53.50 not ELMS LEGAL.

      Any advice anyone?

        My advice draws on many years' legal experience. Pay the cheque into your bank.
