Excel Parking Ticket >14 days

After some advice please!

I received a postal parking ticket from Excel >28 days after the incident. The issue date was 28 days after the incident.

Reading the threads on this forum, I am unclear if I can go back under the FOPA 2012 given I first received notification >14 days?

I have already appealed the decision and had it dimissed by the IAS. My original appeal was I had bought a ticket for parking - but unfortunately paid on an app and paid the wrong car park. IAS did tell me to go back to Excel as there were mitigating circumstances and Excel has the discretion to cancel the ticket. I took this advice but failed to get anywhere... instead had a very rude man on the phone from "Customer Services".

Any advice greatly appreciated - I am finding this whole process so stressful!!

They would not entertain an appeal now. As you have identified yourself as the driver POFA cannot help you.

Thanks for your response. Does the fact it was issued >14 days not matter now then?

That > 14 days was protection provided by POFA to the keeper. You have identified the driver and therefore POFA does not assist.

Just reading into this more... the incident occured 30 May 2022, when private parking fines were reduced to £50 under a new code of practice. The ticket was issued 27 June 2022 for £100 (i.e a date after the code if practice was withdrawn on 7 June 2022). Should the level of charge be allowed, given the code of practice was in place when you incident happened?!

The legislation limiting to £50 has not yet been enabled.
