  • PCN notice not received

    Good afternoon everyone. I am new to the forum and hope you can assist.

    Yesterday we received a PCN charge notice, however we never received the original PCN so the fine has now increased by 50% to £195.

    If the orginal had been received it would had been paid in full as we did many years ago when we received one before.

    we have not been able to physically speak with anyone at the council and when I tweeted them to say we were more than happy to pay the original fine but not the extra due to not receiving the first letter.

    The council said “you need to either pay the £ *or* wait for the next Notice to be rcvd (Order for Recovery of Unpaid Debts) & file a declaration. You can then formally appeal on the basis that the PCN was not received via the post. Unf these are the only 2 options available”

    I was also given an email address to email, however the query bounced back as undeliverable as the councils email inbox was full.

    The email has been sent again and an auto response has been received with upto 30 day response time.

    We dont have this time as if we dont pay in 14 days we get the next stage letter with an extra charge. Order for Recovery of Unpaid Debts.

    I have told my other half to just pay it all and forget it but hes said no, hes happy to pay the original amount of £130 which he would have paid if we had received the original PCN

    Im not sure where we go to be honest.

    The council is correct. Wait for the Order for Recovery and appeal on the basis that you did'nt receive the pcn. The OfR will explain how to do this. This will reset back to te NtO stage (£130). You can then either appeal that or pay the £130.

    Was the pcn for a parking or a moving traffic contravention?

      Thank you so much. Thats reassuring. It was the later, taking a left turn where he wasn't supposed to.
