  • Nottingham City Council PCN

    Hi,

I need an advice regards my PCN from Nottingham City Council.
The PCN says: parked in a restricted street during prescribed hours (contravention code: 01).

My car has been parked on the pavement ( it was wide enough for pedestrians and wheelchair users). I have been using this spot since November last year from Monday until Friday and there was no problem.

After the incident I made a quick research and found out that the possible problem is a double yellow lines.

If I am right, this was a genuine error. I believed parking was allowed because i have been parking there for over two months and never received a ticket.

I am wondering if there is a point to appeal.

Please have a look on the photos. Thank you.

The DYL cover not only the carriageway, but pavement/verges up to the adjoining property boundary, so the PCN has been lawfully issued.

The upside is that you have had parking for 40 days for less than a £1 a day. The downside is you will have to find somewhere else to park.

You could always ask the council to use it's discretion on the basis that after two months parking there without problem you had a legitimate expectation that you were not in contravention. It's highly likely they will reject but will re-offer the discount.
