    Hi All I have been sent a PCN for causing an obstruction, The car was quite away from the gates which were locked and plenty of room so no obstruction occurred, I was only there for 5 minutes and 26 seconds, going into the shop which owns the car park, there Click image for larger version

      Dear Sirs,

      I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

      You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give the invitation to keeper in the format prescribed by section 9 (2) (e) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

      There is no legal requirement to name the driver at the time and I will not be doing so.

      I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

          Parked causing a obstruction of any kind , that’s rather subjective and gives them the power to determine anything is causing an obstruction which is an Unfair term and condition of use


          They need painted car parking bays and rules placed around the car park telling its users only to park within the bays to stand a chance of winning

            Hi Ostell I have received an update from the company insisting they have not fail to comply I have to provide driver's details or pay I have attached letter, What are your thoughts

              So just wait and see what happens. When they finally reject they should give you a POPLA code to continue your appeal
