  • Parking Charge Notice

    Good afternoon,

    I've received in the post today (11/6/21) a parking charge notice from Smart Parking. The letter is dated 9/6 with the alleged date of contravention being 27/5.

    My question is can I dispute this as I received this outside of their 14day period (27/5-11/6)? Or, as the time on the ANPR image shows me entering and exiting the carpark 11mins and 19seconds apart, can I dispute it on the time factor? I assume there must be na amount of time allowed before charges occur. I'm a driving instructor and was dropping a student off after a lesson at her work place.

    Edit so that the identity of the driver cannot be inferred. On the assumption that the pupil was driving in then:

    Dear Sirs,

    I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

    You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

    I was not the driver at the time and as there is no legal requirement to name the driver I will not be doing so.

    Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.

      Just wanted to say a massive thank you. I've received a letter from Smart Parking confirming that on this occasion (having posted the letter you suggested) they are cancelling my parking charge.

        Smart are sometimes smart and give in when they know they will lose at POPLA

        Anyway a good result
