  • Parking Eye ANPR PCN - Double Dipping - Centurion Point, Chester

    Hello,

I received the attached letter today from Parking Eye, I use the car park on a regular basis to drop off and pick up my wife when she is going to work as it it a safe and convenient place.

I don't stay for any longer than 5 minutes at any time, therefore it is obvious that the camera in question has taken a picture whilst arriving on the afternoon of 07/11/2019 at 15.22, whilst collecting my wife and then subsequently pictured me arriving on the morning of the 08/11/2019 at 07.32 whilst dropping her off.

There doesn't seem to be any other images to support me leaving or entering the car park in question, therefore the suggestion is that the car has been parked all night. There are no barriers restricting access or coin operated machines to purchase tickets. The car park in question services various retail stores and a snooker hall. I don't reside in the area as I live over 10 miles away and would not any reason whatsoever to leave the vehicle overnight.

I have tracked my movements over the two days using my mobile phone and Google Maps Location History that clearly demonstrates my location and that I was driving my vehicle between the hours of the alleged offence.

Any assistance with this matter would be appreciated, I have not contacted Parking Eye in any way nor submitted an appeal as clearly this is an instance of double dipping via the APNR cameras and any appeal would be fruitless.

    Thanks

PE do recognise double dips so you must tell them that in no uncertain terms

Received my second letter today from PE, the front part is the same as the first but the back part has a case law section that outlines the judgement in ParkingEye v Beavis (2015) and how PE won their case.

Ive still not made any contact with them in regards to the claim

So why did you not write to them as advised and tell them of their double dip error

I was advised through another forum not to engage in discussions with PE as they wont acknowledge my appeal plus I am having trouble downloading my location info from google as I was using this as evidence to support my response. I am currently looking through case law and other online documents to get a better understanding of my legal position.

Ignoring has not been the advice for some considerable time.Â*Â*

Ask the retail stores onsite if they could have the parking notice charge cancelled, all declined as they say they have numerous enquiries about the parking charge continuously and refer everyone to ParkingEye.

I have now submitted an appeal to PE and enclosed a copy of my timeline tracking information for the car that demonstrates the car could not have been parked for the length of time.

See what I get back from them
