  • Old parking PCN's being persued by BW legal

I would really appreciate some advice

I have a "letter of claim" from BW legal for two PCNs from November 2014. They want £100 for each of two PCN's and £100 legal costs total: £300.

I was the keeper but not the driver and only knew about the charges after the notice to keeper arrived - I don't know the dates of letters arriving - far too long ago! I was abroad on one occasion - but It was actually a family member who co-habited for a short time with someone at the premises - but was not responsible or named on the lease.(they separated long ago) Landlord promised but failed to provide permit - advised to park in visitor bay until able to obtain permit and not to worry.

I have no paperwork or copies of notices as I thought it had been resolved. I requested more information at the time from Premier Park - which they refused to provide - apparently they don't have to. I did try via an online company having paid £18 to get matter resolved - they put in complaint - as it seems they used same DVLA details for each PCN - however now struggling to get said company to communicate. I do have those emails regarding the matter. Last advice was from them : they are in wrong, doubt they will persue - and I hear no more. So I assume it has all gone away and get on with life.

I have asked Premier park for a subject access request - asking for everything they have about me and about any parking charge notices - and in same email disputed the 'debt' I did not reveal driver ID. They repsonded asking for two forms ID which I have sent - but they also want one of the below to prove my identity in relation to providing me the information:
    • The ownership details from the V5 Logbook
    • Written authorisation from the Registered Keeper named on the V5 Logbook where this is not listed as yourself
I have emailed back 2 days ago to point out - I can'I access that information - as the vehicle was sold some years ago - and since they already had that information at the time - and are now using that information to persue a claim against me - I think it is an unreasonable request. I have not heard back.

I have also emailed BW legal to tell them I am waiting for data.
The deadline BW legal have given me to pay up or respond is 15/8/19, after then they estmate a total of £451 will be due; I am not willing to send back all the details of my income/expenditure!
I would like to know the best way to respond - any help gratefully accepted
    Thank you

Have you contacted the DVLA to find out how many times the details were requested for the car? SubjectAccess.Requests@dvla.gov.uk One access means that only 1 of the PCNs could be valid.

All that is due is the amount of the original PCN POFA 4 (5) plus the court costs

Thank you - I will contact the DVLA to find out
Should I return the form BW legal have sent to me - stating that I do not think I owe the debt?
      Help very much appreciated
