  • BW legal letter of claim

    I received a letter of claim which has given me until 15th August. I am the registered keeper of the car but wasn't driving the car when it was photographed leaving the carpark on the 19/02/2019. The first letter from pps (notice to keeper) is dated 26th Feb however the post mark on the envelope which i still have is 13/03/19 which was past the 14 day discounted period. I wrongly believed that ignoring the letters that followed was the thing to do. I understand I should have sent a SAR, am I too late to do this? Any help would be really appreciated. Thank you

    Ignore has not been the advice since 2012.

    You contact the solicitor and tell them that you weren't the driver, the letter was delivered after the 14 day relevant period and there can be no keeper liability because of their failure to comply with the requirements of schedule 4 of the protection of Freedoms Act 2012.

    Keep that envelope safe, that is your proof of the missed 14 days.

    There are probably more POFA fails in the letter so if you post it up suitably redacted others will look at it.

    You can SAR PPS for all they hold about you.
