The location of the contravention was on all documents as Frankies and Bennies I whited this out along with the reg , but today i went past and the post signs outside even say 20 mins stay ! Cant expect people to stay for only *20 minutes.;D it s a joke

Will it just be Section 9 2 (E) I would include on my letter back to them both saying they are not upholding the POFA ? I am guessing we cant just assume they don't know and they must have it in writing that they do not know ?

Very dangerous, I know, but I'm assuming that the location of F&B's is given on the NtK?

& if that location is, say, the name of a town, there is only 1 F&B's there?

Transferrence of liability/invitation to name the driver is on the rear of the NtK.

Hmmm

The NtK looks to be reasonably compliant, unfortunately.
(That's why we try & get pics of the actual NtKs first.)
Hardly surprising, actually. I would imagine that, given the huge volume of these that Brit/BWL have punted out recently, & the length of time that they've been doing so, they have probably closed the loopholes every time someone pointed them out.

On the plus side, I think I can see another 'tack' to take.

Did you send that PAP form?
Could you give a timeline of what you sent & when?
& what you received & when.
(I could try & work it out from the thread, but it's best to get exact dates.)

& did you get proof of postage for all the stuff you sent?

SAR to Britannia - Was sent 10/03/2019 - No Response as of yet apart from automatic reply.

Email to Britannia - Sent 11/03/2019 - Data Protection Question response sent from them 12/03/2019 - 18/03/2019 Resent with my updated response - 20/03/2019 Their last email in regards to my points.

Also what shall i include on the PAP in terms of the reason why i am disputing , am i okay to keep this clear if i have requested for the other documents ?

Ask for
A true copy of the agreement between the landowner (or their authorised agent) & Britannia which allegedly gives Britannia authority to operate on the relevant land, redacted only as strictly necessary.
A true copy of the KADOE agreement between Britannia & DVLA.
A map of the relevant land detailing positions of all site signage
A true copy of planning permission for the erection of site signs.
A true copy of all site signs which Britannia propose to use in evidence.
Details of the device used to capture the relevant photographic images of the vehicle.

& add
that you are not prepared to accept letters of authority which purport to give authority. You require early disclosure of actual copies in order to asess your legal position &, if necessary, obtain legal advice.
& you are not going to accept being ambushed by production of evidence for the first time in a court hearing.

Definitely get proof of posting.
& keep a copy.

Don't be surprised if they answer 'no' to all!

I would imagine that they will react (privately) with extreme indignation,& 'publicly' (ie in their response to you) give spurious reasons as to why they are not obliged to disclose this info to the 'Great Unwashed'!
