I think you may end up needing to make an application to the Court here. Costs are normally automatic when theres discontinuance but not with small claims, to get costs in small claims you have to show unreasonable conduct, and the opponents have the right to reply. Thus its seemingly likely that an application will be neededI work for Roach Pittis Solicitors. So, I received an email from the court yesterday and they said " Thank you for your email and we note your comments with regard to claiming for costs. However. the Court cannot provide advice to litigants on the conduct of their proceedings. You are recommended to seek independent legal advice from a Solicitor or the Citizens Advice Bureau.Comment
