  • CP Plus Charge Notice

    Hello All,

    I would welcome some advice and hope i am posting on the right forum.

    The driver was at MOTO Toddington Service station for over 2 hours and have received a Charge Notice through the post for £60 from CP Plus.
    Should driver pay this charge or appeal?

    So edit so that the identity of the driver cannot be inferred. Use " the driver ........." etc.

    post up a redacted copy of the PCN, leaving dates

        AGAIN edit that post. Use "the driver......" etc.

        That page is missing some of the information required by POFA to hold the keeper liable therefore only the driver, if known can be held liable.

        Here's a letter i would send.:

        Dear Sirs,

        I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

        You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

        There is no legal requirement to name the driver at the time and I will not be doing so.

        I do not expect to hear from you again, or you debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

        Here's POFA Paragraph 9 is of interest. If that quoted section is not on the back then send the letter.

            The keeper received this response back:

            Dear Sir,

            Thank you for your correspondence relating to your Parking Charge Notice (PCN).

            Further to your representations, we have investigated your claims and can confirm that your Notice has subsequently been cancelled in full and no further action will be taken.

              No, the driver did not receive the response, the KEEPER received the response.
