  • Access to DVLA database suspended

    Earlier this month I read that numerous councils and public authorities had their access to DVLA database suspended for abusing the system

    Im particularly interested in LB of Camden as a friend of mine is challenging a PCN he received for a traffiic offence allegedly committed at the beginning of June
    Ive managed to find that LB of Camden had their access suspended on 19th June 2012, the reason for suspension being - No contract in place.
    The information then goes on to say Re-instation date if available - CLOSED DOWN 16/08/2012

    If there was no contract in place would that suggest that LB Camden had previously had, but not renewed an expired contract, or if they never had a contract in the first place?

    Wondering what effect, if any, this would have on my friends appeal

    By the sound of it, your friend needs to speak to DVLA to clarify whether LB of Camden ever had lawful authority to access DVLA databases. If not, it may amount to a data protection issue and that would need to be referred to the ICO.

        If Camden gained unlawful access to the DVLA database, it wouldn't help with the appeal, but it would certainly give you a very big stick to beat them with later on.

          If Camden did gain unauthorised access, surely any PCN they subsequently issued would be deemed invalid?

            It would render disclosure to any bailiff company potentially unlawful, possibly, illegal.

              Sent an additional FOI to LB Camden. Ive asked for details of the organisation who obtains DVLA data on their behalf due to their access to the the database being permanently cancelled.

              Also spoken to ICO who were not aware that many local authorities including Camden had their access permanently cancelled.

              ICO seemed to suggest that as long as the 3rd party providers were acting for proper purposes and within their registration they would be allowed to pass on/sell this data to local authorities/organisations such as Camden who are denied access to this info in the first place because of their abuses.

              This doesnt seem quite right???
