  • V5C changed after dad died by his partner unlawfully

    Hi,

My dad died in October. He wasn’t married but in a long term relationship and died intestate but I now am the executor - he told me everything was going to me and my brothers.

My dads partner is a multi millionaire and highly controlling. Dad inherited some money from my Grandad before he died and bought a sports car for sentimental reasons. This falls as part of his estate.

My dads partner has with held the car and refuses to give it to us - she said dad gave it to her (untrue) but has provided no proof of this. We have a receipt from the owner that sold it to him and have requested the V5C.

Annoyingly as she has the V5C she has written to the DVLA after his death and told them she is next of kin with no proof and they have changed the details so now she is down as registered keeper. She plans to sell the car - has three others of her own.

We are planning to take her to court ourselves as using a solicitor will cost £40k but how do we deal with the DVLA and report what she has done with the V5C please? They are very unhelpful on the phone.

    thanks so much
