  • Alcohol Blood Test Delays

My son (honestly, it wasn't me) was recently involved in a car accident, his was the only vehicle involved.

He was taken by ambulance to hospital and a policeman breathalysed him at the hospital, he came in at over the limit.

Due to his injuries they couldnt do an evidential breath test so they took blood and sent it for analysis.

his all happened over 8 weeks ago now, does there come a point in time where the case times out or do the police/CPS have as long as they like to porduce the test results?

Obviously we are reluctant to chase it up but it would be nice to know either way.

    Thanks in advance

They have six months to lay information before the magistrates.

If your son truly believes he was close to the limit if he had been drinking it might be worthwhile having the sample he was given privately analysed. Results and interpretation can vary.
