Advice needed after receiving a plead by post for uninsured keeper of motor vehicle

Hi there,

I have just received a Single Justice Procedure notice for being the registered keeper of a vehicle which did not meet the insurance requirements, contrary to section 144A(1) of the road traffic act 1988.

Now i totally appreciate that we were late in declaring the vehicle SORN due to the car DPF filter going and being totally undrivable and that i should have ensured it was declared SORN but due to miscommunication between me and my wife and her having LUPUS and us also having two children with autism we were late in doing so which we are guilty of not declaring SORN on time. The car was never left on a public road or driven as it was undrivable and was stored in my wife's parents garage until we could save the money required to get it fixed.

So i would like to ask if this summons will be just a fine of £100 or will it be the fine and 6 points for it not being insured even though it was not driven. I am soon starting my paramedic training and have a clean license, if i was to receive 6 points then my career is gone so i am very worried.

Any help or advice is greatly received

As the charge is for being the registered keeper of an uninsured vehicle (not for using the vehicle whilst uninsured) the penalty does not include points on the licence.

However, If the offence is keeping a vehicle which is not insured then you should have received an enquiry letter, followed by a fixed penalty of £100 (£50 if paid within 33 days), and only if that was ignored should a summons be issued. Did you not get these earlier letters?

Hi DES8 Thank You for your response. The only letter i previously received was the fixed penalty of £100 letter which then i immediately declared the vehicle SORN. I assume that regardless of this i will still owe the £100 fine

You should have paid the fixed penalty as the case has now unfortunately proceeded past that stage, and is due to be decided by a magistrate..
The fine could be (but unlikely) upto £1000 plus a criminal record.

However the DVLA are only looking for money so it might be worth calling the DVLA, explain the circumstances and explain you misunderstood the forms and offer to pay £100 . They might accept or knowing that you are wanting to settle they may ask for a higher amount, Alternatively they could also refuse your offer to settle and take you to court anyway and then if found guilty you will have to pay more in fees.

Hi all,

I understand this is an old thread but I am in a very similar situation. I pleaded Guilty to keeping a motor vehicle which does not meet insurance requirements. My DD bounced and I was very depressed at the time due to finances.
I have received a letter with a fine today.

Does this mean I have a criminal record?

I too am due to start university to train to be a paramedic.

Any advice or information from the op would be great too. I thank you in advance.
