    Hi guys,

    can anyone help.???
    My friend got a PENALTY FOR UNTAXED CAR AND TO PAY £316.00 ALTHOUGH THE CAR WAS SORN AND EMAIL RECEIVED FROM DVLA OF A SORN CONFIRMATION.
    IT READ" WE HAVE RECEIVED EVIDENCE AT 11.15 HOURS ON 28.12.2017 THIS VEHICLE WAS BEING USED OR KEPT WHILST ON STATUTORY OFF ROAD(SORN) declaration was in forcein (.......) IT IS AN OFFENCE TO USE OR KEEP A SORN'D VEHICLE ON A PUBLIC ROAD AND OUR RECORDS SHOW THAT YOU WERE THE VEHICLE REGISTERED KEEPER ON THAT DATE.

    I WANT TO CHALLENGE THIS BECAUSE THE VEHICLE BROKE DOWN, WAS ALSO SORN AND NOT IN USE WITHER. THE COUNCIL HAVE NOW TOWED THE CAR AWAY AND NOW THE DVLA WANT TO CHARGE MY FAMILY £316.
    PLSSS CAN SOMEONE HELP!!!!!!

      At the time of the offence where was the car?

        The car was parked at my friends front house which is rented by her mother and all neighbors park there. So its a matter of house blocks and anyone living there can park there.

              Then it is valid, you are not able to park a SORN vehicle on the public road, https://www.gov.uk/government/upload...tification.pdf please see point 3.
              Sorry i'm just thinking out loud, it might be irrelevant, I am not employed in anyway in the legal profession, please ensure you research any advice I give before using it I have been known to be wrong on multiple occasions.

                  Even privately owned car parks (e,g Shopping centre or pub car parks) are treated as public if the public have access to them,
