  • Two charges, but only one on court summons????

    I was arrested for driving over the limit, blew 70. I hit 2 parked cars and have 'failure to stop' (which I disagree with but they have witness statements) hanging over me as well as the DUI.
    The court date has arrived through the post but it only has 1 charge, the DUI, no mention on the failure to stop.

    The paperwork is for 'guilty anticipated plea court' and I did indicate at the police station that I would plead guilty to that.

    So.... Has the other charge been dropped? Or will I get another court date for that one?

    I can't contact the CPS because it's the weekend and it's driving me mad not knowing!

    It is most unlikely that the two offences have been separated.

    In any case, the most you can expect for the "Fail to stop" (FtS) is an additional fine. The excess alcohol offence attracts a fine and a ban of between 17 and 22 months. The FtS is unlikely to be viewed as the more serious offence and where two or more offences are committed at the same time, a ban or penalty points can only be imposed for the most serious.

    The likelihood is that the CPS has taken the view that since the FtS will not see any significant increase in sentence, together with the possibility that you may plead not guilty, it is not worth pursuing.
