    Hi there i received a letter of moneybarn saying they have terminated my agreement and will be taking the car back because i missed a couple of payments cause i had financial difficulties but now my partner is working and she can contribute to the payments i offered to pay the full arrears but they wont accept it and told me its to late i havent paid 1 3rd of the agreement is there anythinh i can do

    Hi Andy,

    How many payments did you miss in total, did you inform Moneybarn that you were in financial difficulties?

    Did you receive a default notice letter giving you time to repay?

      Hi rob i missed 2 payments and yes i told them i was in financial difficulties i received a default letter of them i then phoned them again told them i can pay my arrears of in full but they said its to late and ceatta will be coming to collect the car

        Hi Andy,

        Any chance you could post up the letter from Moneybarn and the Default Notice for us to view? Obviously remove any personal information. You could email kati@legalbeagles.info, I'll tag her so she is aware @Kati

        If you have missed payments and they have temrinated the agreement lawfully and correctly and you haven't paid 1/3 off, then there may not be much more you can do other than to offer a repayment plan, with a reasonable amount of what you can afford. If they reject it and insist on going to court then we could look at the situation then but the starting point I guess would be to await for someone to collect the car and go from there.
