    Quick update. Phoned them again and said basically what is in the letter above. Got passed between people and put on hold for ages, eventually they agreed to it and told me manheim will be in touch to collect it.

    Now the fun begins disputing damage charges lol.

      Be sure to take photos of the outside and inside just in case they start alleging damage.
      I would suggest not to sign any paperwork Manheim ask you to sign but it is entirely your choice. If you sign for it, you will have a lot more hassle than if you didn't.

      Don't feel pressured if Manheim say they can't take it away without a signature. Simply state that there is no obligation or requirement for you to sign and if he can't collect it that is fine, leave it there and you will cancel the insurance and responsibility falls with Moneyway - they will soon take it off your hands.

      Also a point to note: have the Manheim agent sign the V5 but do not hand it over to him. It is your responsibility to notify the DVLA and you should send this to them youself, making sure you get a proof of postage receipt. If you don't that will become another problem for you no doubt. Alternatively I believe you can notify the DVLA online but not sure what information you need.

          No I wouldn't, why sign something that makes it more difficult to argue when there's no obligation?.

          There's a couple of people who have posted on here who did exactly the same and were getting harassed saying they had signed the damage report so they are liable. Whilst signing that doesn't mean to say you are obliged to because you have limited liability, if it went to court and unless you know how to argue and present your defence, the judge is going to award it in favour of the finance company.

          It is just not worth the hassle but as I said, its your decision to make.

            Been a while since i posted.

            The company came and collected the car the first week of may. I was quoted around £400 for damages but refused to sign the report. Since then i have not received a bill or anything from them.

            I have just been having a look at my credit report and the finance company moneyway (secure trust bank) have reported 3 months missed payments on my credit file when the agreement has ended in april. Is this juat a case of phoning them and getting them to correct it?

              Hello,

              You can call them but not sure whether the person on the other end of the phone has authorisation to do so. If they refuse then the only way to get them to comply would be to take court and action and get an order requiring them to update the records.

              I would suggest a letter to them outlining the fact they are reporting inaccurate data which is in breach of data protection act. You require them no later than 14 days to amend your records accordingly and confirm this is the case or you will take further action, including reporting them to the ICO and/or commencing legal proceedings for an order to remove the incorrect data being reported.

              There's a couple of suggested templates on other threads if you look that will help you.

                Hi again.

                After a bit of phoning back and forward. The guy on the phone checked the system and said that there were payments late in may june and july. When i told him that it wasnt possible as the agreement ended in april he replied that since they did not receive the money from the auction company until july they still send for the payments from me and this is why it is marked down late and he is saying they cant change it. I argued that the business between the auction company and the finance company had nothing to do with me and my liability had ended. I asked to speak to a supervisor but there are none available apparently Any help would be appreciated.

                  If you want them to remove, it go down court proceedings route. They are reporting inaccurate information which is having a negative impact on your credit file. A letter before action would be the starting point but only do it if you are prepared to follow it through.

                  The other route is make an official complaint then go down the Financial Ombudsman route which you'll need to give 8 weeks for them to investigate and come back with a final decision and then you have to wait a certain amount of time before th Ombudsman will make a decision, perhaps another couple months maybe longer.

                    ***Just wondered if you had a link to the suggested templates above please as I have a Next default which is causing issues when I do not have an open account with next!! Cannot seem to get it removed as everyone is passing the buck!!***
