If you didn't get the mailer daemon message then the message was received. Sadly unless they write cancelling then it's always hanging over you until it's statute barred.

WRITE to them telling them the name of the driver using the address given above. and getting proof of postage from a post office. That way then if it does advance to court then you can show that you informed them of the driver before proceedings started and therefore they have no claim against you.

@Mystery email delivery is not guaranteed! Just because you do not get the daemon message does not mean that it has been delivered. Many reasons for not delivered and no return message, including, but not limited to, false positives by spam and anti virus software. I've been working with someone and trying to exchange information by email. About 50% of the messages are not getting through over the last 4 days. I get no notification that it has not been delivered. This is an POP3/IMAP email server problem at the host.

No it's in the spec of email that delivery is not guaranteed. You could put on the delivery Status Notification flags or Return Receipt but not all mail servers will allow acknowledgement, or users be bothered to acknowledge receipt.

If you go to court and say keeper liability doesn't apply because i told them who the driver was, look here's the email i sent and i didn't get a mailer daemon message to say it had bounced it doesn't matter what might have happened because it'd take a heck of a lot to persuade anyone that they probably didn't get it.

By your logic they could say that the contents of an envelope were nothing and win. They can't.

Get a proof of posting if you do.

As it's a civil matter you don't need to go to extreme lengths to prove anything.
