  • Help! PCN Parkingeye!

    Ok to cut a long story short back in July I received a parking charge notice for parking in a staff car park at the hospital. It was not myself it was a friend I lent the car to. Anyway I appealed it saying I was not the driver at the time. From this I heard nothing until the beginning of October when I received a letter before county court claim stating the amount of £70 was still outstanding, I tried every way possible to get in touch with them but no direct email, telephone number or address! So sent a further appeal as this was the only way I could get in touch with them. I stated all of the above only to get a letter today stating "it remains outstanding and this has now been processed for further action. This is because you have not appealed to POPLA and now this time has passed"
    So my question is do I have to pay this £70?
    If I had heard my appeal was unsuccessful I would have appealed to POPLA. However now it is too late!!

    I would await the verdict in the supreme court on Wednesday. If Barry Beavis beats Parking Eye tell them to get stuffed (probably but check the actual verdict to be sure) but if he loses tell them the name and address of the driver and it is no longer your problem.

      Thanks for your reply M1, I will do that and hope nothing happens in the meantime. My problem is however they will not accept the name of the person driving they are just stating I must pay this and I cannot get in touch with them to give them the name as the only contact I have for them is the appeals form on the internet

        The appeals form page gives a postal address fo PE.

        Tell them that you were not driving and the driver was name and address of driver

        Also tell them that as you have now named the driver then, in accordance with POFA, they can no longer hold you liable.

        Send this and get proof of posting from the Post Office.

        You could phone them up to check that it has arrived, number on the appeal page. You could also send an email

        They will probably refuse but, tough, you have complied with the requirments of POFA

            Thanks ostell, so do you think they will listen/accept this even though they are saying it's too late? They are now saying I can't appeal to POPLA, as the 28 days has passed.

              This is what I was thinking M1 surely there will be CCTV and they'll see it's a male even if not, the driver is willing to accept the notice!

                Oh don't worry about proof. If someone else was driving and you supply that info then keeper liability is dead.

                These parasites have been known to ignore what they consider to be "late" driver nominations but the law is clear.

                Anyway lets wait for Wednesday.

                  So given the judgement shall I get in touch with Parkingeye and provide driver details?

                    Yes and email will be fine although if you wish to spend a quid odd on recorded delivery as well, feel free.

                      Ive tried to email them numerous times at info@parkingeye.co.uk but it just keeps failing to send. Is it posdible theyve changed this email address?

                        Well it's either phone for a valid address (0330 555 4444) but not to give details over phone as you'll have no proof or send as planned.

                          You do have the postal mail address! Send it to that address with proof of posting from the post office.

                              I know but while you keep moving all that hay to find that needle then PE could start a court case and thereby remove the "Not a Driver" reason to deny liability.
