  • Speeding camera obscured by trees - can I challenge ticket?

Hi, my partner received a speeding ticket for 38 in 30 zone - the camera is completely obscured by trees (he has photos) and there is only one camera warning sign on the other side of the road which would be obscured if a bus or lorry went past - again, he has photos of this. One 30 sign is visible on the same side of the road before the camera. What are his chances of successfully appealing?

The camera doesn't have to be visible or signed.

Hi thanks M1, we were led to believe that there are quite strict rules about the siting of speed cameras - ie they can't be obscured by trees, there have to be signs leading up to where the camera is, signs on both sides of the road etc etc. From your reply is this not true then? Thanks

.........we were led to believe that there are quite strict rules about the siting of speed cameras..........
Whilst I'm not questioning the reg's on the siting/visibility of cameras, there are also other "strict rules", they're called the speed limit.....doing 38 in a 30 is cut & dry. I'm not taking a moral stance (I've been caught speeding many times over the years) but I take the view of if you risk breaking the speed limit, then get caught, take it on the chin and pay the consequences.

Acpo GUIDLINES are what you are referring to. In a court case they are no more than bogroll.
