  • Parking Suspension- how much notice?

    Something weird happened today and was wondering if anyone can shed any light on what occurred was legal or not?

    So, we've been parked in our permitted area all week (all correct badges shown), we wake up about about 8am and have a voicemail left at 7.30am (on a Sunday) with a voicemail saying that if we don't move our car within 15 minutes it will be towed and we will be fined because of a parking restriction in place.

    We haven't seen any notifications of parking restrictions, the car is parked on our road so we would have seen them on passing. Our local council website advises that tennants must give the council 7 days notice of a parking suspension request, so should that not mean that we should see the notices with about 5 days notice? From what we can understand the notices only appeared Saturday afternoon, which is surely not enough notice to be fair? What if we'd been away for the weekend?

    My partner goes outside to find officials about to tow our car (which would incur a fee) and manages to negotiate with them and we move the car, turns out it only needed to be moved a less than a metre to be OK.

    At this time we don't expect to be charged, but just in case they do try to (we've had rotten luck with car bills lately) where do you think we stand on this?

      We thought we hadn't, when we moved the car this morning there was no paperwork. But, just went to check and we do have a PCN to pay. Very annoyed. Do you think we have a case to argue?

        You can always appeal the pcn ... if you were totally unaware of the Parking suspension, then you have a chance

          I think we will try. Just seems a bit cheeky as it looks like they've put those notices up Saturday afternoon/evening giving people a teeny tiny chance of seeing it.

            By any chance, were you already parked up when the notice appeared too?

              Yes! We've been parked in that spot for about three days. We wouldn't have parked there if the notice had been there.

                It's definitely worth appealing (especially as it appears they put the suspension in place while you were parked up)

                  Contact the council and ask them if they took note of any vehicles that were parked when the suspension notices went up ... take photos of the signs (if you can) and post them up on here too

                    Annoyingly the sign has now changed to another date notice, so we can't get photographic evidence of the sign in question. We've had such bad luck with these things lately I feel like we should take photos of everything everytime we park!

                      How did they know your phone no. for the voicemail, I've never come across that before.

                        Yea, we found that weird too. We're in Brighton. I don't know if they have our phone number on record for the parking permits maybe? I found it so weird that they thought it was acceptable to be calling people at 7am for that kind of news!

                          What happens if someone parks in the suspended bay?

                          Only vehicles that have been identified on your application will be able to use the suspended bay.
                          NSL, our on-street parking enforcement team, check suspended bays early in the morning, on the day of suspension. If a vehicle is parked there, they may be authorised for relocation, even if the vehicle is displaying a Blue Badge or they were parked before the suspension signs were put up.
                          The relocation service only runs until mid-day and we cannot guarantee the relocation of offending vehicles.
                          They haven't complied with their own protocol. re-location is just that, they move the car to another spot without issuing a pcn
