Who is the legal owner of car
Hi , My daughter had a car bought for her off her husband, he got it on finance. Now since he left home 6 months ago he got a Bank loan and paid off the vehicle. Now he say`s the Bank owns the car, is this right and does my daughter not have a say in this, since it was a gift to her, the car is not in her name...... thanksTags: None

Unless there is a court order I don't see how your daughter can "lose" the car which was gifted to her and is in her possession.
On the other hand the second car, in possession of your daughter's ex, is a different matter.
What do you mean when you say it is in her name? If you refer to the V5C we have shown how easy it is to change the name, and it does not prove ownership.
Was the vehicle bought jointly?
How were the family finances arranged?
Did one work while the other cared for the home and children?
Without a lot more detail it is impossible to apportion ownership and in any case as the ex has possession, how is it proposed your daughter sells the vehicle without the cooperation of the ex.
As an aside if there were two cars in the family (and assuming they were more or less on a par with each other) why shouldn't they have one each?

What is the practical problem here?
He claims the bank own the car. Has the bank asked for it?
Your daughter claims ownership.
She has possession.
The V5 is in her name
She has insured the vehicle in her own name, (and presumably advised the ins. co. on the proposal that she was the owner)
Other than husband (separated/divorced?) being a***y and trying to wind up your daughter is there a problem?
I would just ignore him

Yes she has her own insurance. There are 2 vehicles involved in this , the one we have already discussed and the one he took with him 6 months ago , this one is in her name so what happens about that, like you say the V5C is no proof she own`s this car but i suppose they both own as they both bought it when they were together, so has she no say in this one...

Not all car insurance companies will insure you as the 'main driver' on a car insurance policy if you don't officially own the car.
Worse still, if you aren't up front about the vehicle's ownership and your insurer finds out they are likely to cancel your policy - something that could leave you high and dry if you did need to make a claim.
Insurers take ownership of a vehicle as the person named as the 'registered keeper' on the DVLA's records. They also assume that the person insured as the 'main driver' on a policy will use the car most of the time - this is something you need to bear in mind when you're shopping around for car insurance.
