  • Parking Contravention Charge

    I arrived at my local train station operated by NCP and found there was only one parking space available, but one car was parked over the white line and it was impossible to get my car in and open the door. So I drove to the bottom of the car park, ensured there were no yellow lines or signs that said do not park and parked without causing obstruction to any other vehicle.
    I had already paid for the car parking an hour before I left home by mobile.
    When I recieved a parking ticket which stated it was for "Contravention: Not Parked correctly within the markings of a bay space". I appealed against the ticket and have just heard back that I have been unsuccessful.
    Can anyone advise me how to word an appeal to POPLA as I feel the ticket is grossly unfair.

    Obviously needs edited to suit. As long as it contains the bit on genuine pre estimate of loss you should be fine. The rest is just extra in case they mysteriously change tack on GPEOL which must be well over 1000 wins at popla so far.

            And the saga continues............so thanks to Mystery1 I used the excellent template to appeal to POPLA against the parking charge notices issued to me whilst I was away on business for 'not parking correctly within the markings of the bay space' at my local railway station. I quoted the Verification codes in my letter to POPLA and had not heard anything until today when I recieved letters demanding payment from a company called Debt Recovery Plus Ltd!
            I immediately contacted POPLA and they cannot trace my letter; I have sent a scanned copy over and they are trying to find it now and although the lady was very nice she did say I would have to prove I posted it!!! I did not send it recorded delivery so how can I do that? What will happen if they say they have not recieved it and I am outside the 28days of appeal period. what/how should I respond to the Debt company? I am really worried as I have never had anything like this and do not want my credit rating affected. I would be grateful for any advice or help.

              Well that's a bit crap. Hopefully they'll find it. Sadly as it's all pretty unregulated there isn't much i can think of if they don't.

              Having said that your credit file will not be an issue unless they take you to court, you lose and then take longer than 28 days to pay what you would then owe. I would kep annoying popla and ignore the rest unless a letter before action or court papers turn up. You could write and say you've appeal to popla so stop annoying me but unless popla find it or see sense then not much else you can do accept ignore or pay and you don't really want to pay it (certainly i wouldn't)

              Another reason i hate posting stuff when i can do it free online.

                If anyone from the debt company turns up , tell them you are currently appealing the debt - that should give you some breathing space - otherwise, my advice would be to just ignore the letter for now. (I'm sure other Beagles will have ideas too)

                Fingers crossed POPLA finds your letter tho' (and remember to send others recorded/signed for - so you get proof of postage and delivery) :tinysmile_twink_t2:

                  Thanks - could kick myself for not doing it online or sending it recorded delivery! They are demanding £300 pounds, even though I paid up front in advance by mobile for 3 days parking. So just so I am clear - if they take me to court, I should attend and then if I lose and have to pay, will I also incur costs too? I don't want to be even more out of pocket than I have to be.

                    Potentially although I'd say the original "fine" plus £100 on top is near enough the max they'd get. £300 ? not a chance unless you failed to turn up or wasted the courts time arguing about nothing etc. Costs are limited unless you behave unreasonably and defending isn't unreasonable.
