  • Incorrect Citation Details

    (Sorry, I posted this in the Welcome area but think that is should be here instead)

    I have received a citation for a speeding offence (96mph in a 60mph zone) however, some of the information on the Citation is incorrect:-


    My Name is spelled incorrectly
    My Date of Birth is incorrect
    The Make of Motorcycle I was riding is spelled incorrectly

    As I presume they would have got this information correctly from the Vehicle Licencing authorities by quoting the Vehicle Registration number, do I have any grounds to successfully dispute the Citation in order to get the case dropped?

    The best place to post this question is probably Pepipoo. The guys there specialize in this sort of thing.

    For what it's worth i understand that if the Notice has been given to you at the scene, and thus you are fully aware of the circumstances of the allegation, minor errors, for example spelling mistakes, will not prevent a prosecution. However, some errors are regarded as so fundamental that they will prevent a case proceeding. Typical examples are if the location detailed is completely incorrect and some distance from the exact place at which the offence is alleged to have occurred. In order to challenge a case along these lines, you need to establish that it is practically impossible to relate a Notice to the incident itself.

    From what you say I assume tho' you were picked up on a camera, but I still think minor errors won't prevent the case proceeding.
