PCN for parking in a bay to the left of a designated cycle lane with double yellows.

  • PCN for parking in a bay to the left of a designated cycle lane with double yellows.

    Received a PCN01.

    Parked in-between the white lines (on all 4 sides) of a parking bay, which is situated to the left of a designated cycle lane, which has double yellows alongside the kerb, which is at the furthest point from the car.

    The signage is a single 'no waiting at any time' yellow sign which is on the pole on the pavement beside the cycle lane.

    I believe this penalty has been incorrectly applied as I was not parked in the cycle lane.

    Does anyone have any help in this area please?

    DYL's operate 24/7 and apply to the whole carriageway.

        1. Is the situation similar to those small cars parked outside Grovsenor House? If so then you need to check with planning where the highway boundary is . If that land between the pavement and the front of Grovesnor house . You can see that that is not highway as some the buildings further up come right to the edge of the footpath .

            It's a hotch-potch. It's a double width one way street where the right hand lane has been marked with part chevron hatching, part cross hatch bays (for access) and part (although unmarked ) apparent unrestricted parking bays.

            I would argue that due to the poor signage and road markings, there is a legitimate expectation that parking was allowed in the unmarked bays.

            The only fly in the ointment is the single No Waiting At Any Time sign right where you parked, but it's not unreasonable to assume that this applied to the cycle lane. None of the other three 'bays' have any signage at all.

            The council is unlikely to accept this and you would have to go to adjudication.
